Terms and Conditions of Use - DatePALOP

Welcome to the DatePALOP Terms and Conditions of Use ("Terms"). These Terms constitute a binding agreement between you and ROÇA TEC, the owner and operator of the DatePALOP platform, which is accessible through its website and mobile applications.

By creating an account or using DatePALOP, you expressly accept these Terms and our Privacy Policy. If you do not agree with any provision, you must not use the platform.

To use DatePALOP, you represent and warrant that:

• You are at least 18 years old or have reached the legal age of majority established in your country of residence;
• You are not prohibited from using our services under applicable laws;
• You have provided and will maintain true, accurate, and up-to-date information;
• You are solely responsible for maintaining the confidentiality of your login credentials and for all activities carried out through your account.

DatePALOP reserves the right to suspend, cancel, or delete accounts that violate these requirements or these Terms.

DatePALOP provides different functional modes, including Dating, Professional/PRO, and Community Resources. Users are responsible for the visibility settings they select for each profile and acknowledge that information shared in Professional mode may have different visibility from information shared in Dating mode.

4.1. User Responsibility

DatePALOP allows users to publish content in Feeds, Groups, Messages, and Profiles ("User-Generated Content" or "UGC"). Users are solely legally responsible for all text, photographs, videos, links, and information they publish or transmit on the platform.

4.2. License Granted to DatePALOP

By publishing content on DatePALOP, you grant ROÇA TEC a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, use, reproduce, modify, adapt, publish, and publicly display such content solely for the purposes of operating, promoting, and improving DatePALOP services.

4.3. Rules of Conduct and Prohibited Content

It is strictly prohibited to publish or transmit any content that:

• Is unlawful, defamatory, libelous, slanderous, hateful, racist, xenophobic, or discriminatory;
• Promotes or contains pornography, sexual exploitation, non-consensual nudity, or violence;
• Constitutes harassment, stalking, intimidation, or threats against other users;
• Infringes the intellectual property rights, trademarks, patents, or image rights of third parties;
• Contains pyramid schemes, chain letters, unauthorized advertising (spam), or malware;
• Discloses the personal information of third parties without prior authorization (doxxing).

4.4. Disclaimer and Moderation

DatePALOP acts as a provider of hosting and technological infrastructure and does not carry out editorial control or prior monitoring of content published by users in Feeds or Groups. ROÇA TEC reserves the right, but not the obligation, to remove, block, or moderate any content that violates these Terms, without prior notice.

If you identify any content that violates your rights or these Terms:

• Use the "Report" buttons integrated directly into posts, profiles, or groups within the application; or
• Send a detailed notification to contact@datepalop.com, identifying the URL/link or exact location of the content and the reason for the report.

For users in Brazil, in accordance with the Brazilian Internet Civil Framework (Law No. 12.965/2014), DatePALOP will remove content identified as unlawful following notification or a court order, as applicable under the relevant legislation.

6.1. Payment Processing

All payments, including PRO Subscriptions, Boosts, and Highlights, are processed exclusively through the official Apple App Store and Google Play Store platforms.

6.2. Automatic Renewal

Subscriptions automatically renew unless cancelled by the user through the relevant app store (Apple or Google) before the end of the active subscription period.

6.3. Account Deletion

Deleting your DatePALOP account does not automatically cancel an active subscription in the Apple App Store or Google Play Store.

The platform is provided "as is" and "as available." DatePALOP and ROÇA TEC do not guarantee that your use of the platform will meet your expectations or that the service will be uninterrupted or error-free.

DatePALOP reserves the right to modify these Terms at any time. Material changes will be communicated through the platform or by email.

These Terms are governed by the laws of Portugal. In the event of a dispute, the parties agree to seek an amicable resolution before pursuing judicial proceedings. Mandatory consumer rights and protections applicable in the user's country of residence, such as those provided under the Brazilian Consumer Protection Code (CDC), remain unaffected.
